OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crush-by hazards by operating powered industrial trucks not equipped with seat belts in the operator's seat:    a) On or about February 26, 2020, and at times prior, employees of Bonnie's Car Crushers were exposed to crush-by hazards, in that forklifts were operated without seat belt assemblies as follows:        1. A Daewoo 70S diesel forklift was operated without a functional seat belt assembly. Forklift operated on uneven surfaces.      2. A Yale WCI 306 diesel forklift was operated without a seat belt assembly. Forklift operated on uneven surfaces.      3. A Caterpillar propane forklift was operated without a seat belt assembly. 29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    a) On or about February 26, 2020, and at times prior, the employer did not ensure that suitable facilities for flushing of the eyes were provided within the work area for immediate emergency use. Employees were exposed to eye injuries while handling used car batteries containing corrosive substances such as sulfuric acid. The shop does not have a suitable facility for quick flushing of the eyes. 29 CFR 1910.212(a)(3)(ii): The  point of operation of machines whose operation exposed an employee to injury, was not guarded:    a) On or about February 26, 2020, and at times prior, the employer did not ensure that the point of operation of machines whose operation exposed employees to injuries was guarded. Employees in the shop were exposed to amputation and struck-by hazards in that cut-off saws were not guarded as follows:            1. In the furnace room, a Dewalt chop saw with an abrasive 14" cutting wheel was missing its guard.      2. In the maintenance shop, a Dewalt chop saw with an abrasive 14" cutting wheel was missing its guard.
