OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crush-by hazards by operating powered industrial trucks not equipped with seat belts in the operator's seat: a) On or about February 26, 2020, and at times prior, employees of Bonnie's Car Crushers were exposed to crush-by hazards, in that forklifts were operated without seat belt assemblies as follows: 1. A Daewoo 70S diesel forklift was operated without a functional seat belt assembly. Forklift operated on uneven surfaces. 2. A Yale WCI 306 diesel forklift was operated without a seat belt assembly. Forklift operated on uneven surfaces. 3. A Caterpillar propane forklift was operated without a seat belt assembly. Forklift operated on uneven surfaces.
