One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.  a. On or about February 27, 2020, at the Long Ridge Energy Terminal, Hannibal Ohio worksite: the employer failed to provide and assure the use of machine guarding for the caught-in, rotating parts and ingoing nip point hazards associated with the CB5 conveyor belt line. Locations on the CB5 conveyor belt line, such as the hopper feed housing assembly located at the tail end of the belt and the capture ventilation housing located towards the head of the belt, had vertical angle iron structural members which created caught-in hazards due to the unguarded rotating parts and ingoing nip points associated with the powered conveyor belt line. Due to these conditions, conveyor line operators were exposed during daily belt line monitoring activities.

On or about February 27, 2020, at the Long Ridge Energy Terminal, Hannibal Ohio worksite: the employer failed to affix and secure barrier guards to the machine frame of the CB5 conveyor belt equipment at the tail end of the belt line. The barrier guard was used to protect employees, such as belt line operators, from hazards associated with the motor that powered the CB5 conveyor line. The barrier guarding involved multiple sections of expanded metal, some of which were not completely fixed, had sides that were completely unattached and had some sections that were attached with metal wires.

The employer failed to perform repeat exposure monitoring within three months for employees that was representative of the same job classification and work area:  a. an employee who performed belt line operator duties in the section 5 work area (aka CB5 belt line) with time weighted average respirable crystalline silica exposure of 160 micrograms per cubic meter on July 25, 2019,  b. an employee who performed belt line operator duties in the section 7 work area (aka CB6 belt line) with time weighted average respirable crystalline silica exposure of 540 micrograms per cubic meter on July 25, 2019,  c. an employee with a time weighted average respirable crystalline silica exposure of 71 micrograms per cubic meter on September 19, 2019, without a job classification or work area described in the exposure assessment record, and  d. an employee with a time weighted average respirable crystalline silica exposure of 120 micrograms per cubic meter on September 19, 2019, without a job classification or work area described in the exposure assessment record,  The employer had not performed employee exposure monitoring for respirable crystalline silica after September 19, 2019 for any job classification.
