29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average (TWA) sound level of 85 decibels measured on the A scale (dBA), or equivalently a dose of fifty percent: In the main production area at 1000 Sheridan Avenue Chicopee, MA: On or about July 16, 2020, employees operating custom "Stenner" and "Brush" machines as well as the Line 1 "Edger" machine were exposed to noise levels which exceeded an 8-hour time-weighted average (TWA) sound level of 85 dBA, and the employer had not included these employees in a hearing conservation program with all of the required elements. Specifically, personal noise monitoring resulted in 8-hour TWA exposure levels between 87.6 dBA and 92.8 dBA with equivalent doses between 71.9% and 149.2% in five of the seven employees monitored and the employer had not established and implemented a noise monitoring program or follow-up procedures for their audiometric testing program.

29 CFR 1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average (TWA) of 85 decibels on the A-weighted scale (dBA), the employer shall develop and implement a monitoring program. In the main production area at 1000 Sheridan Avenue Chicopee, MA: On or about July 16, 2020, management had not developed and implemented a noise monitoring program when information indicated that employee noise exposure levels, while operating custom "Stenner" and "Brush machines as well as the Line 1 "Edger" machine, may equal or exceed an 8-hour TWA of 85 dBA. Such information includes, but is not limited to, the requirement to wear hearing protection as well as the establishment and implementation of an annual audiometric testing program in 2017.
