29 CFR 1918.11(a): The employer used the vessel's cargo handling gear without ascertaining that the vessel had a current and valid cargo gear register and certificates in accordance with ILO 152 recommendations. (a) Dutch Harbor, AK. - F/V Cindria Gene - On or about March 6, 2020 and at times prior thereto, employees were exposed to failure of the vessel's manufacturer built mounted crane (yard and stay) with Rotzler model TH2.CC.0.0 topping and picking winches with a capacity of 4,500 lbs. in that there was no record of the vessel's cargo handling gear register and/or certificates.

29 CFR 1918.11(c): Entries in the registers and the issuance of required certificates for U.S. vessels not holding a valid Certificate of Inspection issued by the U.S. Coast Guard, were not made by competent persons currently accredited by the U.S. Department of Labor for full function vessels and loose gear and wire rope testing as appropriate, as provided in 29 CFR Part 1919. (a) Dutch Harbor, AK. - FV Aleutian Challenger - On or about March 4, 2020 and at times prior thereto, employees were exposed to failure of the vessel's manufacturer built mounted crane (yard and stay) with Rotzler model TH2.CC.0.0 topping and picking winches with a capacity of 4,500 lbs. in that the crane had no valid and current inspection by a U.S. Department of Labor accredited inspector for full function vessels.
