29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:        a) On or about 03/04/20, at the Planet Fitness Center, under construction, located at the Sweden Corners Plaza, (6515 Brockport Spencerport Road), in Brockport, New York, the employer did not enforce the use of a harness or lanyard to "tie-off" to the basket for fall protection. Employees working from an aerial lift and exposed to falling 16 feet to the lower level.  NO ABATEMENT CERTIFICATION REQUIRED
