29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a)  On March 10, 2020, the employer failed to instruct each employee in the recognition and avoidance of unsafe conditions on the jobsite.  Employees were unable to recognize the hazard of accessing a trench that lacked cave in protection.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not made after every rainstorm or other hazard increasing occurrence by a competent person:  a) On March 10, 2020, following rain the employer failed to ensure that there was a competent person present to perform a daily inspection of the excavation, adjacent areas, and evaluate the need for protective systems.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
