29 CFR 1926.1153(f)(1): The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods were feasible: On or about March 5th, 2020, and at times prior thereto, employees were engaged in dry sweeping silica-containing dust without the use of a sweeping compound, exposing employees to the hazard of inhaling respirable crystalline silica.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: On or about March 5th, and at times prior thereto, workers required to utilize filtering facepiece respirators were not provided training on the proper usage and care of the respirators, exposing workers to the hazards of aggravation of a cardiac or pulmonary disorder, dermatitis or ingestion of a hazardous chemical, or transmittal of disease.
