29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) JAL Premier Homes, Inc., on or about March 12th, 2020, at the location of 330 Milan Ave., Norwalk, OH, 44857:  The employer did not ensure that employees expected to operate the Lull forklift were competent to operate a powered industrial truck through completion of a training program and evaluation.  Employees were exposed to the potential for struck by injuries due to a lack of appropriate training.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:   (a) JAL Premier Homes, Inc., on or about March 12th, 2020, at the location of 330 Milan Ave., Norwalk, OH, 44857:  Employees were patching a roof without the benefit of accident prevention programs to identify and mitigate worksite hazards.  Hazards unmitigated include falls of approximately 22 feet, a lack of fall prevention training, and a lack of forklift safety training.

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.     (a) JAL Premier Homes, Inc., on or about March 12th, 2020, at the location of 330 Milan Ave., Norwalk, OH, 44857:  Employees performing a patch job at the edge of a commercial roof were exposed to fall hazards of approximately 22 feet without the benefit of fall protection or a safety monitoring system/warning line system.
