The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section.  a. On or about March 17, 2020, the employer had not performed employee exposure assessments for Industrial Production room equipment operators who have potential exposure to respirable crystalline silica. Specific products run in Ross mixers, also known as double planetary mixers, have components that contained respirable crystalline silica. Silicosis and lung cancer are illnesses associated with the inhalation of respirable crystalline silica.

The employer did not have an exposure control plan that addressed the tasks that involved exposure to respirable crystalline silica, the controls, practices and respiratory protection used to limit exposure to respirable crystalline silica and the housekeeping measures used to limit exposure for the Industrial Production room employees. Silicosis and lung cancer are illnesses associated with exposure to respirable crystalline silica.
