29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles: a) New townhome construction on Lots #47-#50, Roof: On or about 03/16/2020, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees engaged in plywood sheathing installation while operating these tools at 125 PSI.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New townhome construction on Lot #47, Rear top plate: On or about 03/16/2020, and at times prior, the employer exposed employees to fall hazards of 31-feet, 11-inches to the lower level, in that a fall protection system was not provided to employees installing sheathing on the rear roof. b) New townhome construction on Lot #50, Front roof: On or about 03/16/2020, and at times prior, the employer exposed employees to fall hazards of 24-feet, 2-inches to the lower level, in that a fall protection system was not provided to employees engaged in roof sheathing installation on a 6/12 pitched roof.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. a) New townhome construction on Lot #47, Front side: On or about 03/16/2020, and at times prior, the employer exposed employees to fall hazards of up to 17-feet to the lower level, in that the ladder used to access the upper level had damaged rungs, bent side rails and was not removed from service as the condition of the ladder was not inspected prior to use.
