29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l): a) New townhome construction located on Lot #23, Front side: On or about 03/17/2020, and at times prior, the employer exposed employees to struck-by hazards, in that employees were operating a JLG 6042 All-Terrain Forklift Truck without first receiving training and certifications to operate this equipment. Uncertified operators were in close proximity to others working on scaffold systems and the ground area below.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii). a) New townhome construction located on Lot #23, Front side: On or about 03/17/2020, and at times prior, the employer exposed employees to fall hazards of 41-feet to the lower level, in that the scaffold work platform was not fully planked as employees were engaged in stone installation on the chimney.
