29 CFR 1910.272(g)(1)(iii): The atmosphere within a bin, silo, or tank in the grain handling facility was not tested for oxygen content prior to employee entry:    On or about March 18, 2020, at Valley View Agri-Systems Bin #14, the employer did not test the atmosphere of the grain silo prior to having an employee enter the top door into a confined space. This condition exposed employees to the hazard of encountering combustible gases and vapors.

29 CFR 1910.272(g)(2): When entering the grain handling facility bins, silos, or tanks from the top, employees did not wear a body harness with lifeline, or use a boatswain's chair that met the requirements of Subpart D, 29 CFR 1910.28(j):    On March 18, 2020, at Valley View Agri-Systems Bin #14, the employer did not ensure that employees who entered to conduct unclogging of the corn were provided with harnesses and life lines, thereby exposing employees to hazards associated with engulfment and asphyxiation.

29 CFR 1910.272(g)(4): The employer did not provide equipment for rescue operations, which was specifically suited for the bin, silo, or tank being entered:    On March 18, 2020, at Valley View Agri-Systems Bin #14, the employer had employees perform a grain bin entries without rescue equipment available on site, exposing employees to such as but not limited to engulfment, asphyxiation, and mechanical hazards.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:    The employer failed to report a fatality within the 8 hour reporting period.  The fatality occurred on March 18, 2020 at 10:30 AM, CST and it was not reported to the Little Rock Area Office until 12:00 PM, CST on March 19, 2020.
