29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about March 13, 2020 and at times prior thereto; operators of pneumatic nail guns were not wearing safety eyewear that protected them from impact injuries or flying wood particles.  Abatement certification IS required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) On or about March 13, 2020, and at times prior thereto, a framer was installing sheathing on the front elevation of a single story new build without a fall protection system installed; exposing framer to falls ranging from 10-20 feet. Employer was unable to demonstrate effective use of a fall protection plan for employees working at heights ranging from 10-20 feet on a 6x12 roof in excess of 19 feet while using pneumatic nail guns to apply sheathing. Fall protection plan was not prepared; it did not identify each location where a fall protection method could not be used, document reasons why the use of a conventional fall protection system was infeasible, was not prepared by a competent person familiar with the fall protection standards.  Note: Abatement certification IS required for this item.
