29 CFR 1926.451(e)(1):  When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used. Crossbraces were used as a means of access:  On 3/30/2020, employees from JJ Brothers Masonry were performing masonry work onto a residential building located at 2524 Sommers Road, Lake Saint Louis, MO.  Employees did not have sufficient scaffold access to the upper working levels of the scaffold system.  Employees were climbing on the crossbracing to access the lower and upper levels.

29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level:   On 3/30/2020, employees from JJ Brothers Masonry were performing masonry work onto a residential building located at 2524 Sommers Road, Lake Saint Louis, MO.  The employees were working from a tube welded scaffold system approximately 14 feet above the ground.  Employees were not protected from falling to the lower level.

29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  On 3/30/2020, employees from JJ Brothers Masonry were performing masonry work onto a residential building located at 2524 Sommers Road, Lake Saint Louis, MO.  Employees were not trained by a qualified person in hazard recognition for the tube welded frame scaffold.  The employees were exposed to fall hazards.
