29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Ohio Cast Stone Co. LLC located at Scioto Landing, South Bloomfield, OH 43103: On and preceding April 3, 2020, the employer did not ensure that a stairway, ladder, ramp or other safe means of egress was located in trenches where employees were working. Employees were performing sanitary system installation in an excavation ranging from 5 feet 7 inches to 7 feet 3 inches deep in sandy, fine soil. The trenches did not have any means of egress available for the employees to safety exit in a timely manner. The following condition exposed employees to struck-by/caught-in hazards.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) Ohio Cast Stone Co. LLC located at Scioto Landing, South Bloomfield, OH 43103: On and preceding April 3, 2020, the employer did not ensure that protection was provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of trench. Employees were performing sanitary system installation in an excavation ranging from 5 feet 7 inches to 7 feet 3 inches deep with sections of the spoils on the edge of the trench near the area where work was being performed. Materials on the edge of the trench included loose soil, rocks and large clumps of dirt. The following condition exposed employees to struck-by/caught-in hazards.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) Ohio Cast Stone Co. LLC located at Scioto Landing, South Bloomfield, OH 43103: On and preceding April 3, 2020, the competent person on site did not remove employees and make corrections to hazardous conditions to the trench an employee was working in. Employees were performing sanitary system installation in an excavation ranging from 5 feet 7 inches to 7 feet 3 inches deep in sandy, fine soil. Sections of the spoils recently dug out were on the edge of the trench near the area where work was being performed and no protective system or an inadequate protective system in place. The soil was fine sand in most spots and visibly coming loose throughout the inspection. The following condition exposed employees to struck-by/caught-in hazards.

LLC located at Scioto Landing, South Bloomfield, OH 43103: On and preceding April 3, 2020, the employer did not ensure that employees were protected from the hazard of cave-ins by an adequate protective system. Employees were performing sanitary system installation in an excavation ranging from 5 feet 7 inches to 7 feet 3 inches deep in sandy, fine soil. The areas of the trench being worked had no protective system or an inadequate protective system in place. The soil was fine sand in most spots and visibly coming loose throughout the inspection. The following condition exposed employees to struck-by/caught-in hazards.
