OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an explosion hazard:  a) Northvillage Project, 0.3 miles north of Elam Road on Curly Road, on or about 04/16/2020 - employees drilling into a 16 inch PVC sewer line, to install an air pressure relief valve, were exposed to a sewer gas explosion hazard when they used a dry method, i.e.,  battery operated drill with a hole saw attachment, to drill a hole into a newly installed sewer line that was attached to an active sewer system without testing the line for sewer gas or using a wet method for drilling the hole.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) Northvillage Project, 0.3 miles north of Elam Road on Curly Road, on or about 04/16/2020 - employees in the process of installing an air pressure release valve, were exposed to a cave-in/engulfment hazard while working in an unprotected excavation 8'5" in depth by 20 foot in length by 10-12 foot in width adjacent to an active roadway. The soil was previously disturbed type "C" soil. No protective system (shoring, shielding or sloping) was provided for employee protection.
