Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards.      This violation occurred on or about April 16, 2020, where employees are exposed to a struck-by hazard when dismounting a pneumatic tire compactor while the compactor is in motion.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    On or about April 16, 2020, and times prior thereto, the employer did not ensure an employee(s) was adequately trained to recognize the hazards associated with the operation of the pneumatic tire compactor and safe operation of the equipment.  This exposed the employee(s) to struck-by hazards.
