29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New townhome construction located on Lot #25 Birchmore Drive, Sandy Springs, GA, Top plate: On or about 04/17/2020, and at times prior, the employer exposed employees to falls of approximately 32-feet to the lower level, in that employees were not provided with a fall protection system while engaged in framing activities using the top plates as walking/working surfaces.

29 CFR 1926.651(l): Walkways were not provided where employees or equipment were required or permitted to cross over excavations. Guardrails complying with 1926.502(b) were not provided where walkways were 6 feet (1.8m) or more above lower levels:  a) New townhome construction located on Lot #25 Birchmore Drive, Sandy Springs, GA, Front side: On or about 04/17/2020, and at times prior, the employer exposed employees to falls of approximately 11-feet, 6-inches to the lower level, in that a makeshift bridge used to enter the new townhome unit was not provided with guardrails to prevent falls into the excavated area below.
