29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)JJM Construction, LLC at 1116 North Archer Drive, Sioux Falls, SD 57106: On or about and at times prior to April 30, 2020, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were working on the top plate of exterior walls and within the webbing of roof trusses with no fall protection system in place. Employees were also exposed to fall hazards associated with using the top step of an A-frame ladder to gain access to the webbing of the trusses. This condition exposed employees to fall hazards of 11 and 18 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)JJM Construction LLC at 1116 North Archer Drive, Sioux Falls, SD 57104: On or about and at times prior to April 30, 2020, the employer did not ensure that employees were protected from falls during truss installation involving a single-family home under construction. Employees were straddling the roof trusses and working from the top plates of exterior walls without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 11 to 18 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards: (a)JJM Construction LLC at 1116 North Archer Drive, Sioux Falls, SD 57104: On or about and at times prior to April 30, 2020, the employer did not ensure that employees engaged in framing activities were trained to recognize the hazards of working at elevation and trained in the use of fall protection systems. Employees were straddling the roof trusses and working from the top plates of exterior walls without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 11 to 18 feet. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: a)The nature of fall hazards in the work area; b)The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; d)The role of each employee in the safety monitoring system when this system is used; e)The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; g)The role of employees in fall protection plans; and h)The standards contained in this subpart. Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.

Abatement Note: The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable: (a) The nature of fall hazards in the work area; (b) The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used; (c) The proper construction, use, placement, and care in handling of all stairways and ladders; (d) The maximum intended load-carrying capacities of ladders; and (e) The standards contained in this subpart.
