29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    a)  On or about May 6, 2020, where the use of respiratory protection including, but not limited to, a N95 respirator was required for employees working in the COVID-19 resident areas, the employer did not ensure that a written respiratory protection program was established and implemented.

29 CFR 1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee�s ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:    a)  On or about May 6, 2020, in the COVID-19 resident areas, employees were required to wear N95 respirators when working with residents suspected or confirmed as having COVID-19.  The employer did not provide these employees with a medical evaluation to ensure the employees were capable of safely wearing a respirator such as a N95.
