29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 1743 Silver Lawn Drive (lot# 114), Grove City, Ohio:  On or about May 06, 2020, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while an employee installed framing lumber at the worksite.  The employee was unprotected from the porch roof top of a new build residential home.  The fall distance was approximately 11 feet 11 inches from the roof's eave to the ground level.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. Located at 1743 Silver Lawn Drive (lot# 114), Grove City, Ohio:  On or about May 06, 2020, the employer failed to instruct an employee on the avoidance of unsafe conditions while he installed framing lumber on the porch roof top of a new build residential home.  The fall distance was approximately 11 feet 11 inches from the roof's eave to the ground level.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at 1743 Silver Lawn Drive (lot# 114), Grove City, Ohio:  On or about May 06, 2020, the employer failed to ensure that an employee was protected from flying debris to his eye, when he operated the pneumatic nail gun to install framing lumber.  The employee had not used appropriate eye protection, while he conducted the task and was therefore exposed to struck-by hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. Located at 1743 Silver Lawn Drive (lot# 114), Grove City, Ohio:  On or about May 06, 2020, the employer failed to ensure that an employee who worked on top of the porch roof top level of a new build residential home was protected from falling to ground level.  The employee was exposed to a fall distance of 11 feet 11 inches without being protected from falling.   Within the past five years, the employer had been cited for the same hazards in two different inspections.  José Luis Barcenas Flores was previously cited for a violation for this Occupational Safety and Health standard, which was contained in OSHA inspection number 1205371, citation number 1, item number 1 and was affirmed as final order on February 22, 2020, with respect to a workplace located at 5762 Somersworth Loop, Lewis Center, Ohio.
