29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   A)  Community Medical Center, Toms River, NJ: The employer did not ensure that Emergency Department Technicians that were required to wear N95 respirators such as, but not limited to the Halyard Duck-Bill respirators, were provided a medical evaluation prior to their use of the respirators. Violation occurred on or about 4/1/2020 and thereafter.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  a) 99 Route 33, Toms River, NJ: The employer did not ensure that Emergency Department Technician using a tight-fitting facepiece respirator such as, but not limited to Halyard Duck-Bill N95 filtering face-piece was fit tested as required to protect the health of employee(s) exposed to hazards, such as but not limited to COVID-19.   Violation occurred on or about 4/1/2020 and thereafter.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
