29 CFR 1910.134(c)(1):  The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in a workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer:  a) At Dr. Roberta Bianco DOPC, on or about May 6, 2020 and continuing thereafter:  The employer did not establish and implement a site-specific written respiratory protection program for employees who were required to wear respiratory protection when performing patient care.

29 CFR 1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  a) At Dr. Roberta Bianco DOPC, on or about May 6, 2020, and continuing thereafter:   The employer required employees to wear N95 respirators while providing patient care.  The employer did not provide medical evaluations to the employees prior to their use of the respirator.

29 CFR 1910.134(k)(1):  The employer did not provide effective training to employees who were required to use respirators to ensure that each employee could demonstrate knowledge of the elements covered in 1910.134(k)(1)(i) - (vii):  a) At Dr. Roberta Bianco DOPC, on or about May 6, 2020, and continuing thereafter:  The employer did not provide effective respiratory protection training to employees required to wear N95 respirators.  Employees were not instructed on care of respirator, extended use of respirator, nor seal checks.  b) At Dr. Roberta Bianco DOPC, on or about May 6, 2020, and continuing thereafter:  The employer did not provide respiratory protection training to an employee required to wear a N95 respirator.  The employee was not instructed on how to perform seal checks.
