This violation occurred on or about May 19, 2020 and at times prior, on the Pelican Island Storage Terminal located in Galveston, Texas, when the employer did not conduct a periodic inspection of the energy control (Logout/Tagout) procedure at least annually to ensure that the procedure was followed.

29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors. On or about May 19, 2020 and time thereafter, at Pelican Island Storage Terminal in Galveston, Texas, the employer did not take adequate precautions to prevent the ignition of flammable vapors while welding on storage tanks that contained Low Sulfur Vacuum Gas Oil; including but not limited to Tank 106-37. This condition exposed to struck-by hazards from possible fire/explosion.

29 CFR 1926.352(c): No welding, cutting, or heating shall be done where the application of flammable paints, or the presence of other flammable compounds, or heavy dust concentrations creates a hazard. In the Alternative 1910.147(d)(5)(i): All potentially hazardous stored or residual energy shall be relieved, disconnected, restrained, and otherwise rendered safe. This violation occurred on or about May 19, 2020 and at times prior, at the Pelican Island Storage Terminal located in Galveston, Texas, when the employer permitted contractors to weld in the presence of an explosive atmosphere while modifying an improperly prepared storage tanks, including but not limited to Storage Tank 106-37 which contained Low Sulfur Vacuum Gas Oil. This condition exposes workers to the hazards of a catastrophic equipment failure including being struck by a high energy release from potential fire/explosion.

On or about May 19, 2020 and time thereafter, at Pelican Island Storage Terminal in Galveston, Texas; Employees performed hot work on storage tanks which contained flammable chemicals that were improperly labeled; including but not limited to Tank 106-37 and 106-38 which did not have appropriate flammable hazard warnings according to their chemicals Certificate of Analysis information (CoA).
