29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. Located near the vicinity of 8001-8287 Steitz Road, Powell, Ohio: On or about May 22, 2020, the employer failed to adequately enforce his safety and health program to ensure hazard detection and correction, while two employees transitioned and installed metal shingles, onto the roof top of the second floor level of a new build sentry structure. The two employees were unprotected from falls off the roof top and high reach extended forklift, without any means of fall protection. The fall distance was approximately 16 and 14 feet respectively to the ground level.

Located near the vicinity of 8001-8287 Steitz Road, Powell, Ohio: On or about May 22, 2020, the employer failed to instruct each employee in the avoidance of unsafe conditions while they performed metal shingling work. The employees were therefore exposed to a fall distance of approximately 16 feet off the roof top and approximately 14 feet off the modified scaffold platform to the ground level.

Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. a. Located near the vicinity of 8001-8287 Steitz Road, Powell, Ohio: On or about May 22, 2020, the employer failed to ensure that the employee who worked on top of the modified scaffold platform off the JCB Telehandler Forklift forks, was protected from falling. The employee transitioned metal shingles to the second floor roof top of the new build sentry structure. The employee was exposed to a fall hazard of approximately 14 feet, without any means of fall protection to the ground level.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. Located near the vicinity of 8001-8287 Steitz Road, Powell, Ohio: On or about May 22, 2020, the employer failed to ensure that the employee who worked on the roof top of the second floor of the new build sentry structure, was protected from falling off the unprotected side and edge. The employee was exposed to a fall hazard of approximately 16 feet, without any means of fall protection to the ground level.
