29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about May 26, 2020, located at Redtop Court, Lot 6872, in Marysville, Ohio, the employer did not initiate and maintain safety and health programs for employees performing stone work on a porch roof at heights, thereby exposing the employees to the hazards associated with residential construction activities.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about May 26, 2020, located at Redtop Court, Lot 6872, in Marysville, Ohio, employees were performing stone work on a porch roof without any means of fall protection, thereby exposing the employees to a fall hazard of approximately 13 feet.
