29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 1510 Regency Road, Building 2 Regency Place Apartments, Gulf Shores, Alabama:  On or about May 29, 2020 and at times prior;  acting as the controlling employer allowed his subcontracted employees (Aguinaga Builders Corp) to perform framing activities without fall protection exposing his employees to a fall hazard of up to 21 feet 5 inches to the ground below.  b)  At 1510 Regency Road, Building 5 Regency Place Apartments, Gulf Shores, Alabama:  On or about May 29, 2020 and at times prior; acting as the controlling employer allowed his subcontract employees (Joel Cruz dba Joel Cruz)  to perform roofing activities without fall protection exposing his subcontract employees to a fall hazard of up to 41 feet to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At 1510 Regency Road, Regency Place Apartments Bldg. 2, Gulf Shores, Alabama:  On or about May 29, 2020 and at times prior; acting as the controlling employer allowed his subcontract employees (Aguinaga Builders Corp) to perform framing and decking activities without first ensuring they were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 21 feet 5 inches to the ground below.  b)  At 1510 Regency Road, Regency Place Apartments Bldg. 5, Gulf Shores, Alabama:  On or about May 29, 2020 and at times prior; acting as the controlling employer allowed his subcontracted employees (Joel Cruz dba Joel Cruz) to perform roofing activities without first ensuring the employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 41 feet to the ground below.
