29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Worksite was located at St. Joseph's Healthcare and Rehab Center, 315 East Lindsley Road, Cedar Grove, NJ 07009   The employer required employees including CNAs, housekeepers and transport aides to wear N-95 respirators when exposed to patients including those under investigation and/or confirmed as COVID-19 positive.  However, the employer did not provide these employees with a medical evaluation to ensure the employee was capable of safety wearing a respirator such as an N95.    Violation occurred on or about April 3, 2020 and thereafter.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:  a) Worksite was located at St. Joseph's Healthcare and Rehab Center, 315 East Lindsley Road, Cedar Grove, NJ 07009   The employer required employees including CNAs, housekeepers and transport aides to wear N-95 respirators when exposed   to patients including those under investigation and/or confirmed as COVID-19 positive.  However, the employer did not provide these employees with a fit test to ensure the N-95 fit the employee optimally to protect them from exposure to the virus.    Violation occurred on or about April 3, 2020 and thereafter.

29 CFR 1910.134(k)(1): The employer shall ensure that each employee can demonstrate knowledge of at least the following:  a) St. Joseph's Healthcare and Rehab Center, 315 East Lindsley Road, Cedar Grove, NJ 07009   The employer required employees including CNAs, housekeepers and transportation aides to wear N-95 respirators when  exposed to patients including those under investigation and/or confirmed as COVID-19 positive.  However, the employer did not provide these employees with respirator training to include:  a) Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator; b) What the limitations and capabilities of the respirator are; c) How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions; d) How to recognize medical signs and symptoms that may limit or prevent the effective use of respirators.  Violation occurred on or about April 3, 2020 and thereafter.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:  a) St. Joseph's Healthcare and Rehab Center, 315 East Lindsley Road, Cedar Grove, NJ 07009   The employer failed to report the death of an LPN who provided care to patients including those under investigation and/or confirmed as COVID-19 positive.  The worker died on April 11, 2020. The employer became aware of the employee passing on or about June 3, 2020 and the fatality was not reported to OSHA until June 8, 2020.   Violation occurred on or about June 3, 2020
