29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles: a) New residential construction located on Lot #4, Second level rear top plate: On or about 06/11/2020, the employer exposed employees to struck-by hazards while operating pneumatic Hitachi Framing Nail Guns, in that protective eyewear was not provided to employees operating these tools at 130 PSI.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe: a) New residential construction located on Lot #4, Front side: On or about 06/11/2020, the employer exposed employees to severe laceration and amputation hazards, in that employees were operating circular saws without the lower guard operational, as a wood shim was placed in between the guards to prevent the lower guard from retracting immediately after a cut was made.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction located on Lot #4, Second level rear top plate: On or about 06/11/2020, the employer exposed employees to fall hazards of 18-feet to the lower level, in that a fall protection system was not provided to employees engaged in roof truss installation. b) New residential construction located on Lot #4, Second level rear top plate: On or about 06/12/2020, the employer exposed employees to fall hazards of 18-feet and greater to the lower level, in that the fall protection system provided was not attached to a life-line or other anchor point to prevent falls to the lower level.
