29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: Procedures for selecting respirators for use in the workplace; Medical evaluations of employees required to use respirators; Fit testing procedures for tight-fitting respirators; Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding and otherwise maintaining respirators; Procedures to ensure adequate air quality, quantity and flow of breathing air for atmosphere-supplying respirators; Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations; training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and Procedures for regularly evaluating the effectiveness of the program:   a) On or about June 17, 2020, the employer had not developed a written respiratory protection program for the operators of the MHG Strahlanlagen GmbH Etch Machines. The Etch Machine Operators were required to wear an N-95 dust mask, a half-mask cartridge respirator with a particulate filter or a full-face cartridge respirator with a particulate filter when working in the Etch Machines Enclosure Area.

29 CFR 1910.1025(d)(2): Initial determination. Each employer who has a workplace or work operation covered by this standard shall determine if any employee may be exposed to lead at or above the action level:  a) On or about June 17, 2020, the employer had not determined the lead exposure to Etch Machine Operators when removing the mirror coating during the etching process. The mirror coating product contains up to 0.1% lead.

29 CFR 1910.1025(l)(1)(i): Each employer who has a workplace in which there is a potential exposure to airborne lead at any level shall inform employees of the content of Appendices A and B of this regulation:  a) On July 9, 2020, the Etch Machine Operator was exposed to an 8 hour Time Weighted Average (TWA) lead exposure of 0.0042 mg/M3 or 8.4% of the Permissible Exposure Limit. The employer had not provided training to the Etch Machine Operators on the contents of 29 CFR 1910.1025 Appendix A and B.
