On or about June 17, 2020, the employer required employees to wear NIOSH approved, 3M Brand, tight fitting half face and, or, N95 filtering facepiece dustmask respirators when grinding, mixing solvent-based coatings, and while applying the coatings and the employer did not implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluations, fit testing, and training on the use, maintenance and care of the respirators.
