On or about June 18, 2020, the employer failed to conduct frequent and regular jobsite inspections in relation to a residential construction site in which employees were exposed to electrical and fall hazards while performing framing duties.

29 CFR 1926.404(b)(1)(iii)(C): Each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, shall be visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage. Equipment found damaged or defective shall not be used until repaired.    a.)  On or about June 18, 2020, employees were exposed to electrical shock hazards when using a handheld circular saw with damaged cord insulation in more that one area to cut lumber at a residential jobsite.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a.) On or about June 18, 2020, employees were exposed to fall hazards measured to be 12 feet 11 inches and 12 feet 9 inches while framing a roof of a newly constructed single family home without utilizing a fall protection system.

On or about June 18, 2020, employees were exposed to fall hazards measured to be 12 feet 11 inches and 12 feet 9 inches while performing framing work on a newly constructed single family residential home roof when the employer failed to install a fall protection system before the employees began work.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a.) On or about May 18, 2020, employees were not trained to recognize fall hazards such as, but not limited to, 12 foot 11 inch and 12 foot 9 inch fall hazards while performing framing work on an 8/12 pitched roof, nor were they trained on when to utilize a fall protection system.
