29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns were not protected by protective helmets: On or about June17, 2020, and at times prior thereto, at a workplace located at 7500 Randol Mill Road, Fort Worth, Texas; at the construction site, employees walking and working below workers above them were exposed to the hazard of falling tools and/or materials and were not protected by the use of hard hat.

29 CFR 1926.501(b)(2)(i): Each employee who is constructing a leading edge 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. On or about June17, 2020, and at times prior thereto, at a workplace located at 7500 Randol Mill Road, Fort Worth, Texas; at the new residential site, employees performing decking work on the roof of the entry post without fall protection were exposed to falling more than 14-feet to the lower level.
