29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in a workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer:  a) At Dr. Roberta Bianco DOPC, on or about May 6, 2020, and continuing thereafter:  A written respiratory protection program was not developed where respiratory protection was required for employees, including medical assistants, when performing clinical patient care.

29 CFR 1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  a) At Dr. Roberta Bianco DOPC, on or about May 6, 2020, and continuing thereafter:  The employer did not ensure employees, including medical assistants,  were medically evaluated before wearing N95 respirators while providing clinical care.

29 CFR 1910.134(k)(1)(iv):  The employer did not ensure that each user could demonstrate knowledge of how to inspect, put on, remove, use, and check the seals of the respirator:  a) At Dr. Roberta Bianco DOPC, on or about May 6, 2020, and continuing thereafter:  The employer did not provide effective respiratory protection training to a medical assistant who was required to wear a N95 respirator when providing patient care.  The employee was not instructed on how to perform seal checks.
