OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of rollovers while using the Bobcat MT55 mini loader. 54 Bernie Ave. Leominster, MA. On or about April 25, 2020 employees were exposed to crushing hazards as a result of a vehicle rollover when the Bobat mini loader they were operating was being trans versing a slope (going across the slope) and not directly up and down a sloped area of a residential lawn. The action of trans versing(going across) the slope of the hill caused the mini loader to tip over striking an employee pinning him between the vehicle and a tree trunk. Among other methods, feasible and acceptable methods to correct this hazard is to follow the warnings and recommendations located in the Bobcat MT55 min-loader Owners and Operating manual pages 18 and 46: a) Bobcat MT 55 mini loader Owners and Operator's Manual, page 18, diagram of safety warnings, operators control Panel:" Warning, Avoid Injury or death, operate up and down slopes not across them." b)Bobcat MT 55 min loader Owner's and Operators Manual, page 46, lower right column, " Warning, Machine Tipping or Rollover can cause serious injury or death. Go up and down slopes, not across them."
