OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee, in that the employee was exposed to serious injuries or death from falling tree trunk sections. JOBSITE: A tree felling safe zone/area of 1.5 times the height of the tree was not establish and maintained around the approximately 20 feet high dead tree trunk section actively being removed by a worker positioned in a truck mounted aerial lift cutting trunk sections with a chain saw, and lowering them to the ground using a ground worker and a rope. On or about June 28, 2020, the ground worker holding the rope on the ground approximately 15 feet away from an approximately 20 feet tall tree was struck by a falling tree trunk section when the tree unexpectedly collapsed at the base and landed partially on the worker, crushing his left foot and right forearm.
