29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a. CareOne at the Highlands, 1350 Inman Ave, Edison, NJ On or about April 16, 2020 and thereafter, during the first pandemic surge which necessitated employees at the workplace, such as Registered Nurses (RNs),Licensed Practical Nurses (LPNs), and Certified Nurses Assistants (CNAs),to wear N95s for the first time, the employer did not ensure that medical evaluations were fully compliant and documented for those employees. Violation occurred on or about April 16, 2020, and continuing thereafter.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting face piece respirator is fit tested prior to initial use of the respirator, whenever a different respirator face piece (size, style, model or make) is used, and at least annually thereafter: a. Care One at the Highlands, 1350 Inman Ave, Edison, NJ Fit Testing was not performed for employees such as LPNs, CNAs, and RNs, who were required to wear N95 respirators when providing direct care and services to patients and residents with suspected or confirmed cases of COVID-19. Violation occurred on or about April 16, 2020, and continuing thereafter.
