29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  On or about June 30, 2020 during commercial construction activities at a worksite located at 6035 SOM Center Road Willoughby, OH 44094; the employer did not ensure employees exposed to fall hazards of approximately 20 feet were using proper fall protection. Employees were installing three HVAC units on a roof with no fall protection.

29 CFR 1926.503(c)(3): When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill, the employer shall retrain the affected employee.  On or about June 30, 2020 during commercial construction activities at a worksite located at 6035 SOM Center Road Willoughby, OH 44094; the employer did not ensure employees retained the appropriate fall protection knowledge. Employees were observed not utilizing conventional fall protection and not able to determine appropriate fall protection required when performing HVAC installation.
