On or about July 8, 2020, and at times prior, the employer did not maintain a safety and health program to ensure hazards were identified and corrected onsite while performing stucco work on the outside of the building being erected. Hazards included, but were not limited to, fall protection, scaffold use and safety, use of hazardous chemicals, power tool safety, eye hazards, overhead hazards, etc.

On or about July 8, 2020, four employees working below employees working from scaffold with stucco materials in buckets and hand tools, were exposed to falling objects from the scaffold and were not wearing protective helmets/hardhats.

29 CFR 1926.451(e): "Access." This paragraph applies to scaffold access for all employees. Access requirements for employees erecting or dismantling supported scaffolds are specifically addressed in paragraph (e)(9) of this section. 29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. a. On or about July 8, 2020, an employee was exposed to fall hazards while accessing a supported scaffold platform that was approximately 18 feet-6 inches above a point of access without an acceptable point of access. Employees were accessing the scaffold platform by climbing up the sides and center components of the scaffold frame that were not designed for climbing or access. b. On or about July 8, 2020, an employee was exposed to fall hazards while accessing a supported scaffold platform that was approximately 12 feet above a point of access without an acceptable point of access. Employees were accessing the scaffold platform by climbing up the sides and center components of the scaffold frame that were not designed for climbing or access. c. On or about July 8, 2020, an employee was exposed to fall hazards while accessing a supported scaffold platform that was approximately 5 feet above the point of access without an acceptable point of access. On or about July 8, 2020, employees were exposed to falls from heights and associated injuries while working from an approximately 20 feet-6 inches tall supported scaffold that was not inspected for visible defects by a competent person after the scaffold had been moved from one side of the building to another. The supported scaffold had visible defects such as, but not limited to, improperly supported, guardrails not in place around entirety of scaffold, no proper access, etc.

On or about July 8, 2020, an employee was working from a scaffold at about 18 feet-6 inches above the lower level without being protected from falling to that lower level. The scaffold did not have guardrails or any other fall protection measures in place around the open edges and ends, exposing employees to falls from heights. b.
