OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to a fall hazard. a. On and/or before July 6, 2020, at the job site, the employer did not ensure that employee(s) did not access roofs by ascending and descending on a Cleasby truck mounted conveyor (model: FBR-6-38; S/N: CL050648769-3) while it was running, thereby exposing employees to a fall hazard. In addition, the employer installed rails on each side of the truck mounted conveyor without getting approval from the manufacturer. On or about July 6, 2020, after loading a garage roof with roofing materials, an employee was attempting to climb onto the Cleasby truck mounted conveyor (model: FBR-6-38; S/N: CL050648769-3) to descend from the roof while the conveyor was running which contributed to the employee falling a maximum of 11 feet, 4.5 inches.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. a. On and/or before July 6, 2020, at the job site, the employer did not verify that the personal protective equipment hazard assessment had been performed through a written certification for workplace hazards.
