OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Throughout Yard/Facility - On July 8, 2020 and at times prior to, powered industrial trucks (forklifts) were improperly towed when they became stuck in/on uneven terrain, thus exposing employees to tip over and crushed-by hazards. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to ensure employees follow all policies and precautions for safe operation of the equipment as outlined in the manufacturer's operation and maintenance manual including, but not limited to: 1. Utilize the drawbar pin to pull the forklift if it becomes stuck in/on uneven terrain (e.g. mud, gravel, ruts, etc.). 2. Do not use a forklift for tasks it was not designed to, including, but not limited to, towing other forklifts.
