29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a) Roberto Reyes Construction, LLC., at a jobsite located at 5285 High Point Lakes Drive, Building 3, Westerville, Ohio 43082. On and/or preceding July 1, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a fall protection program for employees exposed to fall hazards.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a) Roberto Reyes Construction, LLC., at a jobsite located at 5285 High Point Lakes Drive, Building 3, Westerville, Ohio 43082. On and/or preceding July 1, 2020, the employer did not ensure employees were protected from falls while working from aerial lifts. Employees were working from elevated aerial lifts without fall protection while framing the exterior walls of the fourth floor, thereby exposed to fall hazards of up to 40 feet.

29 CFR 1926.503(a)(2): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:   29 CFR 1926.503(a)(2)(ii): The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used.   a) Roberto Reyes Construction, LLC., at a jobsite located at 5285 High Point Lakes Drive, Building 3, Westerville, Ohio 43082. On and/or preceding July 1, 2020, the employer did not ensure employees were trained on the correct procedures for erecting a fall protection system while working from aerial lifts. An employee was working from an elevated aerial lift with the rope of a vertical lifeline wrapped around and tied off to an anchor point, thereby exposed to fall hazards of up to 40 feet.
