Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On July 25, 2020 at 6110 Tricia Avenue in Weston, Wisconsin, employees were working on a roof surface nine feet above surface level without utilizing fall protection equipment.

29 CFR 1926.503(a)(2)(iii): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  On July 25, 2020 at 6110 Tricia Avenue in Weston, Wisconsin, the employer did not provide required fall protection safety training for employees who did not associate fall from elevation hazards when working on a roof surface nine feet above surface level without utilizing fall protection equipment.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.    On July 25, 2020 at 6110 Tricia Avenue in Weston, Wisconsin, employees were using a 24-foot extension ladder to access/egress a roof edge nine feet above surface level without the side rails extended at least three feet above the upper landing surface.
