29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.   a) Service Master by McCann, Inc. located at 1125 Carpenter Road Defiance, OH, 43512: On or about July 24, 2020, the employer did not ensure that employees conducting cleaning and remediation activities in a crawl space involving a Sodium Hypochlorite based chemical named MMR Mold Stain Remover, were provided and wore appropriate personal protective equipment such as but not limited to chemical-resistant coveralls.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE).   a)   Service Master by McCann, Inc. located at 1125 Carpenter Road Defiance, OH, 43512: On or about July 24, 2020, the employer failed to select and have each affected employee use the types of personal protective equipment that would protect the affected employees. An employee conducting cleaning and remediation activities in a crawl space with and around hazardous substances, involving corrosive bleach-based material suffered chemical burns due to exposure to hazardous chemicals such as, but not limited to corrosive Sodium Hypochlorite MMR Mold Stain Remover. The corrosive chemical was dripping and leaking on top of the employee while performing cleaning and remediation tasks without wearing the appropriate personal protective equipment such as but not limited chemical-resistant coveralls.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area:   a)  Service Master by McCann, Inc. located at 1125 Carpenter Road Defiance, OH, 43512: On or about July 24, 2020, the employer had no mechanism in place for training employees who worked with hazardous chemicals before the initial assignment. An employee conducting cleaning and remediation activities at a job site worked with hazardous chemicals, including but not limited to corrosive Sodium Hypochlorite MMR Mold Stain Remover while performing tasks in a crawl space. Employees had not received any information or training, which included the health and physical hazards of the chemical being used in the remediation site.
