Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.     a) On or about 07/23/2020 there was no frequent and regular inspection program being maintained in use by a competent person to ensure the job site, material and equipment; such as fall protection systems was being utilized.

29 CFR 1926.453(b)(2)(v): "Specific requirements." Extensible and articulating boom platforms. A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    a) On or about on 07/23/2020, an employee was exposed to a 46 ft. fall hazard while operating an articulating boom platform to frame the side of  a commercial building, without additional conventional fall protection system in place, after detaching from the lanyard.

29 CFR 1926.454(a)(1):  The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: 1926.454(a)(1The nature of any electrical hazards, fall hazards and falling object hazards in the work area.      a) On or about 07/23/2020, an employee was not trained to recognize fall hazards such as, but not limited to, an 46 ft. fall hazard while operating an articulating boom platform nor was he trained on when to utilize a fall protection system.
