29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    Certus Healthcare dba Suburban Healthcare and Rehabilitation located at 20265 Emery Road, Cleveland, Ohio 44128:  a. On or about July 29, 2020, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix).  The employer required employees to wear respirators throughout their shifts while exposed to suspected and confirmed positive COVID-19 residents. The violation occurred on or about July 29, 2020 and after.  b. On or about July 29, 2020, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix).  The employer required Maxim Healthcare Staffing Services temporary employees to wear respirators throughout their shifts while exposed to suspected and confirmed positive COVID-19 residents. 29 CFR  1910.134(d)(1)(ii):The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification:  Certus Healthcare dba Suburban Healthcare and Rehabilitation located at 20265 Emery Road, Cleveland, Ohio 44128:  a. On or about July 29, 2020,  the employer did not provide NIOSH-certified respirators to employees who were required to care for suspected and confirmed positive COVID-19 residents.  The employer provided and required employees to wear respirators labeled "N95."  However, the N95s did not contain certification markings indicating they were certified under NIOSH standards. The violation occurred on or about July 29, 2020 and after.  b. On or about July 29, 2020,  the employer did not provide NIOSH-certified respirators to Maxim Healthcare Staffing Services temporary employees who were required to care for suspected and confirmed positive COVID-19 residents.  The employer provided and required these employees to wear respirators labeled "N95."  However, the N95s did not contain certification markings indicating they were certified under NIOSH standards. On or about July 29, 2020, the employer did not provide a fit test to all Maxim Healthcare Staffing Services temporary employees required to wear respirators. 29 CFR  1910.134(k)(1): The employer did not provide respirator training that ensured that each employee could demonstrate knowledge of at least the following elements: Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator; What the limitations and capabilities of the respirator are; How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions; How to inspect, put on and remove, use, and check the seals of the respirator; What the procedures are for maintenance and storage of the respirator, and How to recognize medical signs and symptoms that may limit or prevent the effective use of respirators:  Certus Healthcare dba Suburban Healthcare and Rehabilitation located at 20265 Emery Road, Cleveland, Ohio 44128:  On or about July 29, 2020, the employer did not provide employees with effective training on the effects of improper fit, limitations, maintenance and care, medical signs and symptoms preventing effective use,  donning and doffing, and seal check of filtering facepiece respirators.  The employer required Maxim Health Staffing Service temporary  employees to wear N95 and KN95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents. The violation occurred on or about July 29, 2020 and after.
