29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) On or about July 11, 2020, at the addressed worksite, the employer failed to ensure that an employee who operated a Crown Stand-Up forklift, Model RC5545-40, Serial No. 1A507424, was properly trained, evaluated and certified to perform the tasks in a safe manner, thereby exposing the employee to struck-by and caught-in-between hazards.

29 CFR 1910.178(l)(2)(iii): All operator training and evaluation shall be conducted by persons who have the knowledge, training, and experience to train powered industrial truck operators and evaluate their competence.  a) On or about July 11,2020, at the above address worksite, the employer did not ensure that an employee required to operate the Crown Stand-Up forklift, Model RC5545-40, Serial No. 1A507424, was provided training by persons who have the training, to train powered industrial operators, thereby exposing the employee to struck-by and caught-in-between hazards.
