29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part.  a) Carrera and Sons Masonry LLC on or about May 21, 2020, at the address of 230 N Holland Sylvania Rd Toledo, OH: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury, including programs related to fall protection and personal protective equipment.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) Carrera and Sons Masonry LLC on or about May 21, 2020, at the address of 230 N Holland Sylvania Rd Toledo, OH: The employer did not ensure employees working from a scaffold platform, were trained in the recognition of hazards associated with this type of scaffold. Fall hazards went unrecognized while employees were performing overhand bricklaying operations from the mast climbing work scaffold platform.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound top rail capacity):  a) Carrera and Sons Masonry LLC on or about May 21, 2020, at the address of 230 N Holland Sylvania Rd Toledo, OH: The employer did not ensure employees were protected from a fall while working from a mast climbing work platform scaffold.  Employees were exposed to a 12' fall to the level below while conducting overhand bricklaying operations. The east and west side of the scaffold did not have a guardrail in place.
