29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  St. Joseph Care dba St. Joseph Senior Living Center located at 2308 Reno Ave, Louisville, Ohio 44641  On or about August 6, 2020, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included provisions in 29 CFR 1910.134(c)(1)(i)-(x). The employer required employees to wear N95 respirators while exposed to suspected or confirmed positive COVID-19 residents.  a.) On or about August 6, 2020 and at times thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear N95 respirators while providing care to suspected and confirmed positive COVID-19 residents.  b.) On or about August 19, 2020 and at times thereafter, the employer did not provide a medical evaluation to determine each Absolute Health Services employee's ability to use a respirator before requiring the use. The employer required Absolute Health Services, Inc. employees to wear N95 respirators while providing care to suspected and confirmed positive COVID-19 residents.   c.) On or about September 22, 2020 and at times thereafter, the employer did not provide a medical evaluation to determine each American Health Associate employee's ability to use a respirator before requiring the use. The employer required American Health Associates employees to wear N95 respirators while providing care to suspected and confirmed positive COVID-19 residents.   d.) On or about July 27, 2020 and at times thereafter, the employer did not provide a medical evaluation to determine each American Medical Personnel employee's ability to use a respirator before requiring the use. The employer required American Medical Personnel, Inc. employees to wear N95 respirators while providing care to suspected and confirmed positive COVID-19 residents.  e.) On or about July 26, 2020 and at times thereafter, the employer did not provide a medical evaluation to determine each OCal Solutions employee's ability to use a respirator before requiring the use. The employer required OCal Solutions employees to wear N95 respirators while providing care to suspected and confirmed positive COVID-19 residents.   f.) On or about August 6, 2020 or at times thereafter, the employer did not provide a medical evaluation to determine each Steel Valley Portable X-Ray employee's ability to use a respirator before requiring the use. The employer required Steel Valley Portable X-Ray Service employees to wear N95 respirators while providing care to suspected and confirmed positive COVID-19 residents.

29 CFR  1910.134(k)(1): The employer did not provide respirator training that ensured that each employee could demonstrate knowledge of at least the following elements: Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator; What the limitations and capabilities of the respirator are; How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions; How to inspect, put on and remove, use, and check the seals of the respirator; What the procedures are for maintenance and storage of the respirator, and How to recognize medical signs and symptoms that may limit or prevent the effective use of respirators:  St. Joseph Care Center dba St. Joseph Senior Living Center located at 2308 Reno Ave, Louisville, Ohio 44641:  On or about August 6, 2020 and at times thereafter, the employer did not provide employees with effective training on the effects of improper fit, limitations, maintenance and care, medical signs and symptoms preventing effective use,  donning and doffing, and seal check of filtering facepiece respirators.  The employer was aware that employees were on-site at St. Joseph Senior Living. An employee was required to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.   a.) On or about August 19, 2020 and at times thereafter, the employer did not provide employees with effective training on the effects of improper fit, limitations, maintenance and care, medical signs and symptoms preventing effective use,  donning and doffing, and seal check of filtering facepiece respirators.  The employer required Absolute Health Services, Inc. employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.   b.)
