29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    New townhome construction located on Lot #19, Roof: On or about 08/04/2020, the employer exposed employees to fall hazards of 11-feet, 9-inches to the lower level, in that a fall protection system was not provided to employees installing siding on a 8/12 pitched roof.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:    New townhome construction located on Lot #19, Cut bench: On or about 08/04/2020, the employer exposed employees to silica exposure while cutting Hardie Plank Siding, in that the DeWalt (Model DWE575SB) 7-1/4-inch circular saw used to cut siding was not provided with the vacuum system (Engineering Control) needed to reduce exposure of the silica dust created while cutting fiber cement siding.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  New townhome construction located on Lot #19, Cut bench: On or about 08/04/2020, employees were permitted to perform siding cutting operations with a circular saw and other employees were permitted to walk and work in close proximity to the cutting area. Employees worked in the area without PPE and or engineering controls to reduce the exposure to harmful Silica dust.
